Mr. Elston focuses his practice on real estate and commercial transactions, corporate securities and corporate formation, zoning issues, sports representation and with the financing, acquisition, development, construction, leasing and sale of commercial, industrial and retail real estate projects. He has experience in all phases of the development of real property, including master planned communities. Mr. Elston is also a Registered Agent with the Major League Baseball Players Association and has represented over a dozen major league baseball players, negotiating over $50 million worth of guaranteed major league baseball contracts on their behalf.

Prior to joining the firm, Mr. Elston was an executive member of a company responsible for the development of a large master planned community. In that capacity, he addressed land development issues and planning and zoning concerns. In addition, he was a Real Estate Broker for an affiliate of the development company and, in that capacity, he was responsible for the sales, marketing, documentation and closing of over $140 million worth of real estate in the Phoenix metro area.

From October, 1984 through May of 1986, Mr. Elston was a Trial Attorney with the Office of Chief Counsel of the Internal Revenue Service, where he litigated cases in U.S. Tax Court and advised the IRS in criminal, bankruptcy, collection, and other general litigation.

From June 1986 - May 1991, Mr. Elston was an executive in the Tennis Division at International Management Group (IMG) in Cleveland, Ohio. Mr. Elston's primary responsibilities consisted of the promotion of Tennis Exhibitions and Events involving IMG's tennis clients, including Chris Evert, Martina Navratilova, Monica Seles, Jennifer Capriati, Ivan Lendl, Andre Agassi, Mats Wilander, Jim Courier and Pete Sampras. In addition, Mr. Elston represented several other IMG clients as their agent for marketing purposes.

Representative Engagements

  • Represented developers of master-planned communities in connection with the rezoning of the community and its subdivisions, assisted with the negotiation and resolution of Arizona Department of Real Estate Subdivision issues, purchase and sale of properties consisting of raw land and finished lots, preparation and review of development agreements, assisted in the architectural review process and engineering phase of development of the master planned community, infrastructure planning and agreements
  • Represented multiple entities and investors regarding preparation of their operating agreements and incorporation, the financing of their projects, and the purchase and sale of real property
  • Represented multiple entities in real estate matters involving work out issues, preparation of Minor Land Divisions, Lot Splits
  • Represented major industrial/office space landlord/property manager in connection with all of its leasing disputes with tenants, drafting of its Leases and dispute resolution
  • Represented developer in its organization, purchase, rezoning and sale of membership interests in connection with development of condominium project
  • Represented limited liability company in its formation, purchase of real property, rezoning of property, and subsequent development as condo storage units
