Mr. Hartman is an intellectual property and corporate lawyer with extensive experience counseling clients holding a broad spectrum of technologies and intellectual property rights. He represents clients in the clearance, registration and enforcement of trademarks in the U.S. and internationally, including litigation in federal courts and in opposition and cancellation proceedings before the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office. He also handles the protection, licensing and enforcement in federal courts of patents, copyright-protected materials, Internet domain names and trade secrets.

Mr. Hartman negotiates and drafts complex agreements involving the acquisition, protection and licensing of intellectual property rights, as well as confidentiality, assignment and non-disclosure agreements. He also works with clients in recovering pirated domain names and halting the infringement of intellectual property rights on the Internet.

Representative Engagements

  • Prosecuted trademark applications and represented clients before the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office
  • Trademark, copyright and patent litigation in the state and federal courts
  • Obtained a preliminary injunction in a trademark infringement matter resulting in the termination of all sales and advertising of infringement goods
  • Obtained a temporary restraining order to prevent a consultant from using and disclosing client materials post-termination
  • Handled some of the earliest administrative (UDRP) and District Court proceedings involving domain name "cyber-squatting"
  • Advised clients with respect to IP acquisition, due diligence, licensing, management and enforcement
  • Negotiated and prepared technology transfer, licensing and other agreements and contracts regarding all aspects of IP rights and ownership
  • Drafted and advised clients on website terms of use, privacy policies, framing, linking and online content and promotions
  • Drafted articles of organization and incorporation, operating agreements and bylaws, asset purchase agreements, by-sell agreements and related corporate documents
